Who determines my appeal?
A Hearing Administrator with the Office of Appeals and Hearings, serving as the Superintendent’s Designee, will review and issue ta determination. The Hearing Administrator is neutral, unbiased, and applies established administrative procedures, policy, and relevant law.
Who can I talk to if I have questions about my appeal?
OAH is able to answer any procedural questions regarding your appeal but will not discuss or give any legal advice to either party. The Hearing Administrator may not speak with either party unless all parties are present by phone or in-person.
Under what circumstances will a virtual hearing be held?
OAH will conduct a review of the appeal on the written record unless OAH decides that there is a compelling reason to conduct a hearing. If either party believes that a hearing is necessary to reach a decision of the appeal, such party shall make a request at the time the appeal or documentation is submitted, with a concise statement of the reasons for this request.
If OAH determines a virtual hearing is needed to clarify the facts, all parties will be notified and will be provided a pre-hearing survey. OAH will schedule and conduct the hearing.
What if I disagree with the determination issued by the Office of Appeals and Hearings?
The appellant has the right to appeal the determination to the Prince George’s County Board of Education (BOE) within 30 calendar days of the written decision. Information on how to appeal to the BOE is included in each determination letter.
